Dec, 2003 : Host Trademarks "Private Label Reseller Plans"
📅 - SeekAmerica Networks, an affiliate of MCHost (mchost.com -> hostpapa.com), a Web hosting provider based in Brunswick, Maryland, has trademarked the term "private label reseller plans" and is contacting hosting providers who use the phrase in their marketing, according to a report published last week by Netcraft (news.netcraft.com).
According to Netcraft, the application was approved by the US Patent and Trademark office on December 9, 2003, granting SeekAmerica protection for the words "private label" in connection with reseller plans. The approval is technically for a service mark, which offers trademark protection for a service rather than a product.
Netcraft said SeekAmerica has also applied to trademark the phrase "host unlimited domains," and has made posts in several online forums requesting that hosting providers cease using both the "host unlimited domains" and "private label reseller plans" phrases.
"If we do not receive your assurances that you will cease all use of the above mentioned marks, we will proceed with legal steps to protect our rights as well as seek damages from your company for federal trademark violation," said Marc Wyss, CEO of MCHost in an email.
SeekAmerica's trademark applications were first made in August 2002.
