Mar 17, 2008 : Japanese ISPs to Ban P2P Pirates
📅 - Reports surfaced around the Internet last week that, in response to pressure from music, software and movie industry organizations, ISPs in Japan have agreed to work with copyright holders to identify customers using peer to peer file sharing services to infringe on copyrighted material and unplug their Internet services.
A report in Japanese news publication the Yomiuri Shimbun said the greatly increased instance of users using P2P file sharing software - specifically referencing the Japanese program Winny - to illegally share music and gaming software was the major motivator for the new move.
Japanese ISPs have considered similar plans in the past to get in the way of peer-to-peer piracy, but had never put them into practice over fear of overstepping or violating certain privacy rights. In 2006 a provider was issued a warning by the Internal Affairs and Communications Ministry that the approach would be considered an invasion of privacy. But ISPs apparently now believe they will be able to effectively identify the especially active cases of copyright infringement and cancel their contracts.
The four industry organizations responsible for putting the pressure on Japanese ISPs include theTelecom Service Association and the Telecommunications Carriers Association, and account for about 1,000 ISPs, including the country's major providers, and many smaller local providers, making this the first effort against piracy that would have the support of Japan's entire ISP business.
The agreement reportedly would have copyright holders use software specifically designed for the purpose to identify the IP addresses of repeated violators, and then send notice of those addresses to ISPs. The service providers would send warning emails to their customers, and would either temporarily or permanently disconnect them if they continued to copy files illegally.
Though the practice may raise some privacy concerns, it may turn out to be less controversial than US practices, which regularly sees the Recording Industry Association of America bringing massive copyright infringement lawsuits against illegal file-sharers.
