Feb 22, 2006 : Dell Sues Web Site Designer


📅 - According to reports released this week, Paul Dell (pauldell.blogspot.com), the relatively smalltime Web site designer based in France says he has been sued by Dell, the international computer manufacturing giant.


Dell, the designer, told ZDNet UK that the lawsuit involves accusations of trademark infringement, unfair competition and "acts of parasitism" related to the Web site he built in 2001, dellwebsites.com.

Representatives for the computer company were unable to confirm to ZDNet whether the company was pursuing legal action against the Web designer, and referred to the situation as an "unsubstantiated rumor."

But Paul Dell says the company has sent him a claim for damages, which includes 100,000 Euro in damages to Dell America, 50,000 Euro to Dell France and an order to pay each Dell company 40,000 Euro and another 500 Euro for each time the word "Dell" appears on his Web site.

He says the company claims dellwebsites.com was launched in an effort to compete with Dellhost, the Web hosting business operated by Dell and sold to Vericenter in 2003.

Paul Dell says he received cease and desist notices in 2002 and 2004, and that he replied with letters explaining that his name is Dell and that he makes Web sites, hoping that would make the intention behind his URL clear.

He says French intellectual property law entitles him to register a company using his surname, even if that name is already in use by another company, as long as the registration is made in good faith.
