Earthlink took legal action against the Alabama Spam Ring, a group of 16 individuals and organizations that allegedly sent out over 250 million spam emails, in February of 2004. In its lawsuit EarthLink charged the two defendants, Damon DeCrescenzo and David Burstyn, of using false names and addresses to hide their identities, in addition to a number of other alleged violations of state and federal laws. They were also charged with credit card theft and banking fraud.
Atlanta-based EarthLink has sued a number of spamming operations and won multi-million dollar judgements, including a $16.4 million settlement against Howard Carmack, the notorious Buffalo Spammer. The company says the aggressive legal action is part of its multi-faceted approach to the fight against spam.
"Today's announcement is the latest in a long list of legal victories that EarthLink has garnered as an advocate for consumers in the fight against spam," says Larry Slovensky, assistant general counsel for EarthLink. "Filing lawsuits against alleged spammers and seeking court orders that put them out of business is an important way that EarthLink helps preserve the integrity of the Internet for all users."
